Copyright law is paramount to theatre writers as it protects their original expression (i.e., the work that they create), but it is not the only form of intellectual property that theatre writers should be aware of. The other is trademark law. Trademark law is enshrined in a federal statute called the Lanham Act, but there are state trademark statutes and also common law claims in certain states. Trademark law protects a business’s brand and/or product.
