The primary legal claim a dramatist needs to be wary of when writing about real people is defamation. Defamation is a state tort claim for harm to one’s reputation. It includes both libel (written defamation) and slander (spoken defamation). A plaintiff in a defamation suit could be an individual or a company.

Defamation is a state-based claim and thus can vary slightly from state to state. However, in general, a plaintiff must prove the following to succeed on a defamation claim:
